Upon approval you will be asked to sign
and agree with the following:

This Vendor Agreement (“Agreement”) is entered into between Victor Ciccarelli and Abex Armory, hereinafter referred to as the “Organizer,” and ____________________ , hereinafter referred to as the “Vendor,” for participation in the small community pop-up market event taking place on _______ at 10845 Woodside Ave, Santee, CA 92071.

Terms and Conditions:

Space Allocation: The Organizer will allocate a designated space for the Vendor at the event. The Vendor agrees to occupy only the allocated space and to adhere to the event layout provided by the Organizer. All spaces are designated 10×10 foot areas in an open parking lot.

Services and Equipment provided: No equipment or electrical service is provided. The vendor is responsible for providing all tables, tents, chairs or other equipment. No generators, heat, or flame producing devices are allowed.

No Vehicles in your booth: Ample parking is available. Vehicles must be parked in designated areas outside of the immediate area of vendors.

Products/Services: The Vendor shall exclusively sell or promote the products/services agreed upon with the Organizer. Any changes to the products/services must be approved by the Organizer in writing before the event.

Prohibited Items for Sale in Your Booth:
Weapons: Firearms, knives, ammunition, or any other weapon that could pose a safety hazard.
Illegal or Counterfeit Goods: Any items that are illegal to sell or distribute, including counterfeit products.

Alcohol: Selling or distributing alcoholic beverages without proper licensing or permits.
Tobacco Products: Cigarettes, cigars, e-cigarettes, or any other tobacco-related items.
Drugs or Drug Paraphernalia: Any illegal substances or items associated with drug use.
Stolen Goods: Products that are suspected or known to be stolen.
Hazardous Materials: Items that are flammable, toxic, or otherwise hazardous.
Made-to-Order Food Items: Selling food that is prepared on-site or made to order, as it may not comply with health and safety regulations.

Setup and Dismantling: The Vendor is responsible for setting up their booth before the event starts and dismantling it only after the event ends, following the set-up and tear-down schedule provided by the Organizer. Vendors may enter the area at 7:00am booth setup must be completed by 8:00am when the event is open to the public. Booths may not be disabled prior to event close at 3:00pm and all vendor equipment/vehicles must be off the grounds by 4:00pm.

Payments and Fees: To secure your space, a non-refundable deposit of $25 is required upon registration. Retail vendors, At the closing of the event, vendors will be charged a fee equal to 20% of their gross sales, capped at a maximum of $150. For display vendors and those not conducting onsite sales, a fee ranging from $75 to $150 will be charged and agreed upon prior to the event.

Insurance and Liability: The Vendor acknowledges and agrees that they are solely responsible for any liability arising from their participation in the event. The Vendor must have their own insurance coverage for their products, booth, and any related risks.

Compliance with Laws: The Vendor shall comply with all federal, state, and local laws and regulations, including those regarding product safety, permits, licenses, and taxation.

Promotion and Marketing: The Vendor may promote their participation in the event through their marketing channels, provided that it aligns with the event’s branding and does not conflict with other vendors’ promotions.

Indemnification: The Vendor agrees to indemnify and hold harmless the Organizer, Victor Ciccarelli, Hawthorne Country Store, and Abex Armory from any claims, damages, losses, liabilities, and expenses arising out of the Vendor’s participation in the event.

Termination: The Organizer reserves the right to terminate this Agreement at any time if the Vendor fails to comply with the terms and conditions outlined herein.

By signing below, the Vendor agrees to abide by the terms and conditions as set forth in this Vendor Agreement.
